Terms of Service

These Terms of Service (“Terms”) govern your use of the Alleymap website at alleymap.com (the “Service”), operated by Alleymap (“we,” “us,” “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Description of Service

Alleymap is an independent, free information service that aggregates publicly available data about live music and cultural events in the New York City area. We do not sell tickets, manage events, or act as an agent for any venue, promoter, artist, or ticketing platform. When you click on an event listing, you are redirected to a third-party website that handles the actual transaction. Alleymap has no control over, and assumes no responsibility for, those third-party services.

Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By creating an account, you represent that you are at least 18 years old or have parental consent.

No warranty on accuracy

Event information displayed on Alleymap is sourced from publicly available venue websites, ticketing platform APIs, and other third-party data providers. While we make reasonable efforts to keep this information current and correct, we make no guarantee, representation, or warranty regarding the accuracy, completeness, reliability, or timeliness of any event information, including but not limited to:

  • Event dates, times, locations, or lineups, which may change without notice
  • Ticket prices, which may not reflect service fees, taxes, dynamic pricing, or door-price changes
  • Availability or sold-out status, which can change at any time
  • Age restrictions, venue policies, or accessibility information
  • Events labeled “Free” may require RSVP, donation, or minimum purchase at the venue

Always confirm details directly with the venue or ticketing platform before attending any event. Alleymap is a discovery tool, not the authoritative source.

Third-party content and links

The Service contains information sourced from third parties and links to third-party websites, including but not limited to venue sites, ticketing platforms (Ticketmaster, Dice, Eventbrite, Resident Advisor, and others), and music services (Spotify).

We do not endorse, control, or assume responsibility for any third-party content, products, services, terms, privacy practices, or actions. Your interactions with third-party websites are governed solely by those sites' own terms and policies. Any transactions you enter into with third parties (including ticket purchases) are between you and the third party — Alleymap is not a party to those transactions and bears no liability for them.

Affiliate disclosure

Some outbound links on the Service may be affiliate links. If you purchase a ticket through an affiliate link, Alleymap may receive a small commission at no additional cost to you. Affiliate relationships do not influence which events are listed, how they are ranked, or whether they appear on the Service. We select affiliate partners based on their alignment with our values, not their commission rates.

Acceptable use

You agree not to:

  • Use automated tools (bots, scrapers, crawlers) to access the Service in a manner that exceeds reasonable human browsing or imposes an unreasonable burden on our infrastructure
  • Systematically copy, reproduce, aggregate, or redistribute event data from the Service for commercial purposes without our written permission
  • Attempt to circumvent any security measures, authentication mechanisms, or rate limits
  • Access, tamper with, or use non-public areas of the Service, our servers, or our vendors' systems
  • Use the Service for any unlawful purpose or in violation of any applicable federal, state, or local law
  • Impersonate another person or entity, or falsely represent your affiliation with any person or entity
  • Interfere with or disrupt the Service, other users' access, or the underlying infrastructure
  • Use the Service to transmit unsolicited communications, spam, or malware

We reserve the right to suspend or terminate access for any user who violates these rules, with or without prior notice, at our sole discretion.

Intellectual property

The Alleymap name, logo, visual design, and original text content are our property or are used under license. You may not use our trademarks, branding, or original content without written permission.

Event factual data (dates, times, venues, artist names, prices) is not subject to copyright and is treated as freely available public information. Event posters, promotional images, artist photographs, venue logos, and descriptive text displayed on the Service belong to their respective copyright owners. We display such content solely for the purpose of identifying and promoting the events it relates to, which constitutes fair use under 17 U.S.C. § 107.

Copyright holders who wish to have material removed should follow the DMCA procedure below.

DMCA takedown procedure

Alleymap respects intellectual property rights and complies with the Digital Millennium Copyright Act (17 U.S.C. § 512). If you believe material on the Service infringes your copyright, please send a written notice to contact.alleymap@gmail.com containing:

  1. Identification of the copyrighted work you claim has been infringed
  2. Identification of the material on the Service that you claim is infringing, including its URL
  3. Your name, address, telephone number, and email address
  4. A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
  5. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf
  6. Your physical or electronic signature

Upon receipt of a valid DMCA notice, we will promptly remove or disable access to the allegedly infringing material, typically within 48 hours. We may also proactively remove material we believe in good faith to be infringing. Repeat infringement may result in permanent removal.

Disclaimer of warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY EVENT INFORMATION, PRICING, AVAILABILITY, OR OTHER CONTENT PROVIDED THROUGH THE SERVICE.

YOUR USE OF THE SERVICE AND RELIANCE ON ANY INFORMATION OR CONTENT OBTAINED THROUGH IT IS AT YOUR OWN RISK.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ALLEYMAP, ITS OPERATORS, CONTRIBUTORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THIS INCLUDES, WITHOUT LIMITATION, ANY DAMAGES ARISING FROM: INACCURATE EVENT LISTINGS; EVENTS THAT ARE CANCELLED, RESCHEDULED, OR SOLD OUT; THIRD-PARTY TICKET PURCHASES; THIRD-PARTY WEBSITES YOU ACCESS VIA THE SERVICE; UNAUTHORIZED ACCESS TO YOUR ACCOUNT; OR ANY CONTENT OBTAINED THROUGH THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).

Assumption of risk

You acknowledge that attending live events involves inherent risks, including but not limited to risks associated with crowds, noise, travel, and public venues. Alleymap is solely a discovery tool and has no involvement in the production, organization, management, or safety of any event listed on the Service. You assume all risk associated with attending any event you discover through Alleymap.

Indemnification

You agree to indemnify, defend, and hold harmless Alleymap and its operators, contributors, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property or privacy right; or (d) any claim that your conduct caused damage to a third party.

Dispute resolution

Before initiating any formal dispute, you agree to first contact us at contact.alleymap@gmail.com and attempt to resolve the matter informally within 30 days.

If informal resolution fails, any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in New York County, State of New York. You consent to the personal jurisdiction and venue of such courts.

Governing law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions.

Termination

We reserve the right to suspend or terminate your access to the Service at any time, for any reason, with or without notice. You may stop using the Service at any time. Sections that by their nature should survive termination (including Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law) will survive.

Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.

Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Alleymap regarding the Service and supersede all prior agreements, understandings, and communications.

Changes to these Terms

We may revise these Terms at any time by updating this page. Material changes will be communicated to registered users before taking effect. The “Effective” date at the top indicates when the Terms were last modified. Continued use of the Service after revisions constitutes acceptance of the updated Terms.
